On January 17, 2010, Aristeids Mertzanis, Kristen Ames-Mertzanis and their 14 month old child Yiannis Mertzanis were staying at a rental house in La Jolla, California. Yiannis walked across a burning hot metal grate that was in the middle of the living room, causing severe burn injuries. He sustained second and third degree burns to his feet, elbows, arms and hands when he fell on top of the hot floor heater grate. He was transported to UCSD burn center where he remained for twelve days receiving treatment and physical therapy.
Plaintiffs filed a complaint in San Diego Superior Court against the owners, developers and managers of the rental property for negligence, premises liability, products liability and negligent infliction of emotional distress. Plaintiffs alleged that defendants Lee Gibbs, Gibbs Ventures, Inc., Sanera, LLC and Southern California Vacation Rentals failed to comply with safety ordinances, statutes, laws and regulations which was a proximate cause of Plaintiff's injuries and damages. Defendants denied any wrongdoing.
Morris and Associates obtained a settlement for the minor Plaintiff in the amount of $675,000.00.
